On the fifth anniversary of the death of his victim, James McMahon appeared
in court, asking for a new trial.
McMahon claims his attorney; Dennis Luttenauer was ineffective in not
letting the jury know of his intoxication at the time of the murder.
Luttenaur testified that he explained the defense to McMahon, who told the
attorney then that he was not drunk at the time of the murder.
McMahon is serving a life sentence for the 2001 murder of Link Dowell.
Testimony in yesterday's hearing was finished. Once he receives the court
transcripts, defense attorney Greg Henry will have a deadline of 30 days to
file briefs.
